JUST IN: S’COURT REVERSES OF SACK MUTFWANG AS GOVERNOR OF PLATEAU STATE

Caleb Mutfwang’s removal from office was overturned by the Supreme Court, which upheld his election as Plateau State governor.

Mutfwang was removed from office as the state’s governor on November 19 by the Abuja Court of Appeals. The appellate court ruled that the PDP had disregarded the court’s directive and mandated that a legitimate congress be held in each of the Plateau’s 17 local government areas.
Only five LGAs in the state hosted the party’s congress, according to the court, “which amounted to a nullity.”
However, because the matter of the primary election that resulted in Mutfwang fell beyond the purview of the lower court, a five-member panel led by Justice Emmanuel Agim overturned the appeal court’s ruling on the grounds that it was perverse.
The Supreme Court made it clear that an election cannot be declared invalid due to issues with nomination or sponsorship legitimacy.
In addition to the fact that the sponsorship issue has long since passed, he found that the Court of Appeal lacked jurisdiction to consider it and that the petitioners, not being PD members, had no standing to contest the party’s primary election.
The Supreme Court ruled that the appeals court erred in concluding that the order has an impact on the National Executive Committee (NEC) in the case of the Plateau State High Court’s order.
